Darf ich im Ausland im Homeoffice arbeiten?

Das Arbeiten aus dem Ausland ist grundsätzlich nicht erlaubt, es sei denn, es wurde vorab ausdrücklich genehmigt. Es gibt rechtliche, steuerliche und organisatorische Gründe, warum ein Aufenthalt im Ausland nicht ohne Weiteres möglich ist – auch wenn es sich „nur“ um Homeoffice handelt.
 

Grundsatz:

1. Der Einsatzbetrieb muss der Arbeit aus dem ausländischen Homeoffice schriftlich zustimmen.
2. Wenn Sie mehr als 49,9 % Ihrer Arbeitszeit im Homeoffice in Ihrem Wohnsitzstaat verbringen, unterliegen Sie in der Regel dem Sozialversicherungssystem dieses Staates. Dies kann zu zusätzlichen administrativen Aufwänden und Kosten führen. 

Ausnahme:
Arbeiten Sie weniger als 50 % Ihrer Zeit im Homeoffice und haben keine weiteren Tätigkeiten im Wohnsitzstaat, können Sie unter bestimmten Voraussetzungen weiterhin im Sozialversicherungssystem des Arbeitgebersitzstaates verbleiben. Voraussetzung ist, dass sowohl der Wohnsitzstaat als auch der Staat des Arbeitgebersitzes die entsprechende Vereinbarung unterzeichnet haben. Can I work from home abroad?

Working from abroad is generally not permitted unless it has been expressly authorised in advance. There are legal, tax and organisational reasons why a stay abroad is not possible without further ado - even if it is ‘only’ a home office.

Basic principle:

1. The host company must give its written consent to working from a home office abroad.
2. If you spend more than 49.9% of your working time in the home office in your country of residence, you are generally subject to the social security system of that country. This can lead to additional administrative work and costs. 

Exception:

 If you work less than 50% of your time in your home office and have no other activities in your country of residence, you can, under certain conditions, remain subject to the social security system of your employer's country of residence. The prerequisite is that both the country of residence and the country where the employer is based have signed the relevant agreement.     3. If the country from which you wish to work from home is not your country of residence, the special regulation         described under 2) does not apply. It must be checked whether an A1 certificate must be applied for or whether         the activity is legally authorised.

Puis-je travailler en home office à l'étranger?

Travailler depuis l'étranger n'est en principe pas autorisé, sauf si cela a été expressément approuvé au préalable. Il existe des raisons juridiques, fiscales et organisationnelles pour lesquelles un séjour à l'étranger n'est pas possible sans autre - même s'il ne s'agit « que » de travail à domicile.

Principe de base:

1. L'entreprise d'affectation doit donner son accord écrit pour le travail depuis le home-office étranger.
2. Si vous passez plus de 49,9 % de votre temps de travail en home-office dans votre pays de résidence, vous êtes en général soumis au système de sécurité sociale de ce pays. Cela peut entraîner des charges administratives et des coûts supplémentaires. 

Exception:  Si vous travaillez moins de 50 % de votre temps en home office et que vous n'avez pas d'autres activités dans votre État de résidence, vous pouvez, sous certaines conditions, continuer à relever du système   de sécurité sociale de l'État où se trouve votre employeur. Pour cela, il faut que l'État de résidence et l'État du       siège de l'employeur aient tous deux signé l'accord correspondant.     3. Si le pays depuis lequel vous souhaitez travailler en home office n'est pas votre pays de résidence, la                       réglementation spéciale décrite au point 2) ne s'applique pas. Il faut vérifier s'il faut demander un certificat A1           ou si l'activité est légalement autorisée.
